Class History of Law II

- The course unit of History of Law II follows the course unit of the 1st semester, which is dedicated to the study of Roman Law, to the family of which Portuguese Law belongs;

- In this course unit we study the evolution of our legal system, from its peninsular antecedents to the founding of the Kingdom of Portugal and the various historical-legal moments in which our law can be systematized thereafter;

- In this context, the importance of the sources of national law, the legal culture of each period, the political-institutional structure of our monarchy is emphasized. The program ends with a brief analysis of the advent of the so-called "Social Law" from the early twentieth century.

2. Period of Ordinary and Foral Law (1143-1245):

3. Period of the Influence of Roman and Canon Law (1245-1769):

3.1. Before and after the Aphonsine Ordinations (1446/7);

3.2. Sources of Law before and after the Afonsine Ordinances;

3.3. Renaissance of Roman Law:

a) School of the Glosadores;

b) School of Commentators;

4. Period of Rationalist Jusnaturalism:

4.1. Influence of French rationalism in Portugal;

4.2. Pombal law reforms:

a) Good Reason Law:

b) Statutes of the University of Coimbra;

5. Period of Political Liberalism:

5.1. Enlightenment, Liberalism and Law;

5.2. The Revolution of August 24, 1820;

5.3. The Portuguese Constitutions;

5.4. The movement of codification;

6. Period of Social Law.
