Syllabus

1. Objectives of the CU and analysis of the program. Methods of evaluation. 2. DUE in the hierarchy of laws. DUE as European Constitutional Law. 3. Sources of the DUE and its normative structure of the DUE. Legal value of TL and annexes and CDFUE. 4. 2007 IGC: Reform Treaty mandate (TR). 5. CIG 2004: TOR mandate. 6. National holiday 7/8. Identification and analysis of regulations in the TEU and TFEU on innovations resulting from mandates (IGC 2004 and IGC 2007). EU organization: Principles, values and objectives. 9/10. Allocation of competences and their protocols. EU and MS assignments. Implicit powers. 11/12. Practical exercise. 13/14. Principles of division of powers. 15. Direct effect of the DUE and the legal systems of MS. TJUE vs National Courts. Procedures for the revision of the Treaties. 16/17. Reviews and 1st Test. 18/19. Fundamental rights and their protection. CDFUE, ECHR vs TJUE and ECHR. 20/23. Internal actions: Internal market and Customs Union. At five o'clock

Objectives

- Acquisition of knowledge about the Treaty of Lisbon and the basis for its formulation, identified by: - The organization of the European Union; - The legal order of the EU (general aspects). The role of the CJEU vs. that of the national courts vs. the ECHR (generic approaches); - EU domains and policies, identified by internal actions and areas related to EU external actions. - Ability to interpret and critique the issues inherent in European Union law.

Knowledge, abilities and skills to be acquired

The DUE program focuses on the Lisbon Treaty, which is structured around four key elements:. Know the EU organization: its general principles, values and objectives of the EU; competences and principles. . Direct effect of the DUE and the normative structure of the national legal systems. The CJEU: the reference for a preliminary ruling and the responsibility for interpreting the DUE. . EU internal action - EU domains and policies: European citizenship and the protection of fundamental rights, through the Lisbon Treaty and the CDFUE, as well as the ECHR and the ECtHR versus the CJEU. The internal market and customs union and the five freedoms. To know the areas of external action of the Union.

Teaching methodologies and assessment

Teaching method: - Theoretical-practical classes - Exhibitions of the subjects, following a previously prepared presentation scheme. - The lessons are accompanied by reading the recommended bibliography. - Encouraging participation. Method of Assessment: Continuous assessment with the following weighting: a) Participation in the classroom (10%) b) Two frequency tests (80%) - (November 2017 and January 2018, respectively) c) Presentation and defense of individual work ) for grade improvement (only 10% of the student's existing grade as defined in points (a) and (b)). . Final written exam, in accordance with the ULHT Assessment Regulations Remarks: Three classes are left for the application of the assessment methods of the 30 classes (1h and 30m / each).
