    This curricular unit aims to make known the functioning of the civil aviation system at international, European and national level. To this end, the sources of air law and the history and development of this branch of law are addressed. We highlight the subject applicable to the use and occupation of airspace and the differentiation of Air Law vs. Space Law. The main International Conventions applicable to the sector are addressed, with special focus on the Convention on International Civil Aviation and its normative system, which will be studied in detail, in addition to the approach to major international, European and national civil aviation organizations. Conventions and other normative acts aimed at contributing to the safety and security of civil aviation, as well as the punishment of acts of unlawful interference against civil aviation, including the issue of disorder passengers and passengers' rights, will also be studied.

    Sources of Air Law Air Law and Space Law.
    History and development of Air Law.
    The 1919 Paris Convention;
    The Chicago Conference and Chicago Convention.
    Other International Conventions and Agreements (Tokyo, Hague and Montreal Convention):
    Disorderly passengers (DL No. 254/2003). The regime of crimes provided for in articles 287 and 288 of the Penal Code.
    Air Operator Liability Regime (Warsaw Convention and Montreal Convention 1999).
    Passenger Rights: In particular Regulation (EC) No. 261/2004, of the European Parliament and of the Council, of 11 February 2004.
    International Civil Aviation Organizations - ICAO
    Aeronautical personnel licenses (Regulation (EU) No. 1178/2011).
    Aircraft Commander Pilot Status.
    The regime applicable to the investigation of aircraft accidents and incidents.
    Search and rescue services.

  • Objectives

    Objectives

    It is intended that students understand and be able to explain the historical aspects that led to the creation of the current legislative framework, especially with regard to the Chicago Convention and the various subjects of its chapters. Additionally, they should be able to use and explain the main terms and concepts applicable in civil aviation. In the end, they should be familiar with the civil aviation regulatory system and the major international conventions applicable to the sector. They must acquire knowledge and skills that enable them to relate the theoretical concepts learned to reality, demonstrating in-depth knowledge of the sector's main legislative framework and its technical aspects, developing their ability to succeed in the labor market, attentive to specializations, knowledge and skills it requires.

    Teaching methodologies and assessment

    The UC, due to its characteristics, is not given to innovative methodologies. The classes take place based on the explanation of the syllabus from practical examples that occurred, thus enhancing a theoretical-practical relationship.
