    The knowledge about the intricacies of the typical employment contract, as well as the rights and obligations that it contains is of great utility and value in the legal trade. The challenge of teaching how to think and reflect, in a more mature, profound and problematizing way, about some of these intricacies, especially insofar as they delve on procedural issues, was what inspired the creation of this discipline. In one semester, a small and significant universe of labor law issues is revisited, while at same time we attempt to unravel relevant procedural issues that are not normally explored in the basic training of legal scholars in Portugal. The course will, therefore, not only have an important theoretical-expository methodology, fundamental for the transmission of a body of knowledge, but it will also be built, throughout the semester, by the students themselves, through their presentation of essays in seminars and its discussion.

    1. Determination of the employment contract and the appropriate procedural means to settle disputes over the classification of the contract, namely the action for recognition of the existence of an employment contract;
    2. Fundamental rights in employment relations and the appropriate procedural means to protect those rights;
    3. Health and safety in the workplace, accidents at work, occupational diseases and special forms of special forms of procedure;
    4. Individual dismissal; disciplinary procedure and the action opposing dismissal on grounds of its unfairness/illegality;
    5. Collective dismissal and action opposing collective dismissal;
    6. Access to Law and effective judicial protection: the contractual vulnerability of the worker and ad causam procedural legitimacy [Standing to sue];
    7. Principles of Labor Procedural Law and its relations with substantive law and Procedural Civil Law.

    Objectives

    This Master's degree seeks not only to provide an added value for those who wish to enrich their curriculum and professional prospects, but also, and mainly, to be a fundamental step for the successful development of future scholars and a path towards an autonomous, critical and technically grounded knowledge on fundamental legal institutes. Given this, it is important to equip the students of this course with essential knowledge on some of the main topics in Labor Law and Labor Procedural Law, so that they may not only learn the rules and principles that regulate these areas of Law, but also so that they may acquire the technical acumen and autonomy that are necessary for the development of autonomous scientific research. This, in turn, requires acquiring additional knowledge and profound reflection on that which is regularly discussed in Courts (case law) and among legal scholars on these topics.
