Syllabus
1- Introductory considerations on the law of offenses: its genesis, its raison d'être and its place
in the Portuguese legal system. The German Referent
2- The main dogmatic categories of the law of the offenses
3- The structuring principles of the substantive law of administrative offenses
4- Structure and structuring principles of the process of the offenses. The different procedural stages and the
need for its proper delimitation: the powers of the administration, the prosecutor and the court
5- Confrontation of some norms of the General Regime of Inordinations with other norms of other "mini-regimes"

6- The need for revision of the General Regime of Infractions
7- The legal regime for the issuing and enforcement of decisions imposing financial penalties (Law No 93/2009 of 1
September) and the road to an EU counter-national law

Objectives
Objectives
It is intended that the student acquires knowledge about the specificities of this branch of law and as soon as
be able to master its main rules of substantive and procedural law by
others from other general ¿mini-regimes¿. It should also be able to question its existence and how
differentiation of offenses against crimes and well realize that it needs a review. At the
At the end of the course unit, the student is also able to understand that the sanctioning right goes beyond
criminal law in the strict sense and disciplinary law, being able to
hypothetical European dimension of it.

Teaching methodologies and assessment
Teaching methodologies and assessment
The classes will consist of a theoretical exposition and a practical part. Will always take place
calling the student to oral and written exposition. To this end, judgments, journal articles from the
specialty and doctrinal texts.
Assessment composed by the elaboration of works (70%) and participation in class and oral performance (30%)
