I) Introduction. The problem of Legal Methodology as a critical reflection on jurisdictional adjudication. The contemporary legal thinking and the claim and urgency of a juridically methodological approach. II) The question about the type of rationality and the plurality of reasons. Three different perspectives (normativism or formalism, pragmatic functionalism and jurisprudentialism) and their paradigms (application, decision, judgement). III) The Legal Method: the 19th century?s answer and the possibility of reinventing today the correlative question. Does the so-called ?standard theory of argumentation? fulfils the conditions which would allow a positive answer? IV) The jurisprudentialist proposal and its methodic model.

Objectives
The aim is providing the futur jurist with the skills he needs in order to consider the major problem of jurisdictional concrete adjudication: there will be first a general approach of contemporary legal thinking and than the exploration in detail of a plausible methodic schema.

Knowledge Cafe sessions to discuss specific controversial topics Colective analysis and discussion of exemplary adjudicative decisions. Teaching is here always based on case analysis.

PROVAS GLOBAIS DE AVALIAÇÃO CONTÍNUA: As duas provas escritas previstas no âmbito da avaliação contínua são obrigatórias, garantindo no seu conjunto a todos os alunos que estejam presentes em ambas (independentemente da classificação obtida) o acesso a uma prova oral. Nos termos do artigo 3.º do Regulamento, os alunos devem cumprir 70 % de assiduidade para terem acesso à avaliação contínua. A inobservância desse requisito implica a exclusão tanto dos testes escritos como da Prova Global Oral.
