Class Public International Law

Students are expected to acquire knowledge of the structure of Public International Law, its foundations and sources, as well as of the way in which international subjects relate to and interact with one another, and of how this relates to national legal orders, in particular the Portuguese legal order. The international protection of human rights will also be addressed. Students should be able to critically assess current international affairs, discerning in them the features of normativity and the international justice inherent to it.

1. Objectives of Public International Law. Public International Law (PIL) vs. Domestic Law vs. Private International Law. 2. The sources of PIL: custom; general principles of international law; case law (the International Court of Justice and the International Criminal Court) and legal doctrine; equity; International Conventions (stages and procedures for the conclusion of Treaties; Reservations; Amendment of Treaties and Termination of their validity). 3. The subjects of International Law: States and their classification; the jurisdiction of States; other subjects of International Law: International Organizations and their role in the international community; belligerent and insurgent States; the individual. 4. International conflicts. 5. International responsibility.

Teaching Method: - Lectures presenting the topics, following a previously prepared outline. - Classes should be complemented by reading the recommended bibliography. - Encouragement of participation. Students are encouraged to read the recommended bibliography in advance and to actively participate in discussions of the subjects under analysis. Assessment Method: Continuous assessment comprising written tests and class participation.
