    This course focuses on disputes arising from legal-administrative relationships. The core of the course is therefore based on the study of the procedural legal guarantees for citizens, from the perspective of a broader guarantee of effective judicial protection. The overall learning goal of this course is the study, understanding, and acquisition of skills for the correct use of the procedural legal means outlined in the CPTA, for the defense and effective realization of their rights. Studying in a way that builds skills in using these contentious means, their requirements, and procedures is particularly important for preparing students, from both a theoretical and practical perspective.

    Part I - Administrative Justice Part II - Administrative Jurisdiction, scope of the TAFs' competencies. The Administrative Arbitration Courts. Part III - Declaratory Administrative Litigation: types of action, procedural requirements, and specificities. Part IV - Urgent Administrative Litigation: specificities Part V - Jurisdictional Appeals. The possibility of Preliminary Referral to the CJEU. Appeal to the Constitutional Court Part VI - Enforcement of Judgments

    Objectives

    Objective 1: study and understanding of administrative contentious procedures (to be practiced in the Administrative and Tax Courts and/or arbitration), in the context of the effective judicial protection of citizens' rights. Objective 2: study, understanding, and acquisition of skills for the practical application of the main types of legal actions: main, precautionary, urgent, and others, as provided for in the CPTA. Objective 3: study, understanding, and acquisition of skills for the practical application of the types of judicial appeals provided for in the CPTA, their connection with appeals to the Constitutional Court, and preliminary rulings to the CJEU. Objective 4::  study, understanding, and acquisition of skills in administrative enforcement process. Objective 5: Achieving objectives 1, 2, and 3 will allow reaching the main goal of preparing students for immersion in practical life, in any legal profession, from an administrative law perspective.
  • Teaching methodologies

    Teaching methodologies

    Depending on the lesson topic, simulations and debates may be used during class, along with analysis of case law,  case studies, flipped classroom sessions, and the completion of (at least) one procedural document.   The evaluation process takes place in two ways:   1- Continuous assessment: 1 written test (weighted at 50%; participation in classes and in-class practical activities 25%; flipped classroom or procedural document 25%).   Students with a special status provided by law or by regulations that exempts them from mandatory class attendance must inform the Professor 90 days before the end of classes so that another form of work or follow-up can be arranged.   2. In addition, there is the final assessment: written test (100%) according to the current regulations.

    Avaliação: instrumentos e parâmetros:

    1- Avaliação contónua: 1 teste escrito (com a ponderação de 50%; participaçáo nas aulas e nas atividades práticas em aula 25%; Aula invertida ou peça processual 25% 

    Os estudantes com estatuto especial previsto em lei ou em regulamento que preveja a não obrigatoriedade de presença às aulas, devem informar o Professor com 90 dias de antecedência ao término das aulas, para que este defina outra forma de trabalho ou de acompanhamento.
