Class Law for Administrative Offences

    The present curricular unit is justified in a doctoral course because it constitutes, at the present time, a sancionatory lawt present in practically all areas of intervention, namely in the economic, financial, competition, e.g. now, also, as an offense to prevent the phenomenon of corruption. Therefore, it is important to problematize its dogmatic categories, its added value compared to other rights and the need for its existence to be profoundly renewed.

    2.- The relevance of the Administrative Sanctionatory Law

    2.1.- Does it make sense in the national and European legal systems?

    2.2.- Consequences of a negative response: should it be replaced by other sanctioning models?

    2.3.- Consequences of a afirmative response

    3.- Challenges of the Administrative Sanctionatory Law after the economic and financial crisis

    3.1.- Critical-problematic analysis of some new administrative offenses, as well as their sanctioning regime

    3.2.- New paths and new proposals for the Administrative Sanctionatory Law

    Understanding and critical reflection on the A dministrative offences Law, as well as on its relevance in the Portuguese and European legal order. Discussing its possible replacement by other sanctioning rights. Critical-problematic analysis of some of the new counterordinances, as well as their sanctioning regime. Problematizing reflection on new paths for this Law

  • Teaching methodologies and assessment

    Teaching methodologies and assessment

    Teaching methodologies are grounded in lectures with further discussion of these subjects which includes the necessary students's opinions according to the syllabus framework. As a continual process, assessment is assigned a weighting of 30% for student's oral participation, and 70% for a final report
