This course unit is essential for equipping students with a comprehensive and practical perspective on the various legal regimes concerning children. It addresses topics such as the child's position within the family covering issues like filiation, adoption, and legal incapacity before examining parental responsibilities regarding the child's person and assets, as well as the regulation of these responsibilities in the event of divorce. The General Regime of Civil Guardianship Proceedings will be studied, with particular emphasis on the hearing of the child. The course will also address the promotion of rights and the protection of children and young people at risk specifically under the Law on the Protection of Children and Young People at Risk and include considerations regarding civil sponsorship. The Educational Guardianship Law will be covered, alongside themes concerning children in the contexts of healthcare, new technologies and social media and the international arena

Objectives
Objectives
Students must acquire the tools to understand, work with, and argue legal positions regarding the subjects taught. They must know, master, and interpret relevant legislation, legal doctrine and case law. They must be able to situate the child within the family context, understanding the various aspects of filiation and adoption. They must identify and resolve issues concerning legal incapacity to contract and parental responsibilities, particularly in cases of divorce. They must recognize the fundamental right of the child to be heard and weigh this right in practical situations. They must master the General Regime of Civil Guardianship Proceedings, the Law on the Protection of Children and Young People in Danger, and the Educational Guardianship Law. Finally, they must be able to develop well-reasoned analyses of topics such as the child in the context of healthcare, the child in the context of new digital technologies and social media, and the child in the international context.

Teaching methodologies
Teaching methodologies
The course is based on a dynamic, participatory learning process supported by digital platforms-such as Moodle and tools for researching and aggregating legal studies and case law. Classes will begin with a theoretical presentation of the subject matter, followed by its application to case studies; this requires students to demonstrate adaptability and argumentation skills, as they must provide legal grounds for their decisions by drawing upon relevant scholarship and case law.

Avaliação contínua
O regime de avaliação contínua é constituído por 2 testes parcelares escritos, cada um com uma ponderação de 50%.
A avaliação contínua pressupõe a comparência obrigatória no mínimo a 70 % das aulas lecionadas, sem prejuízo de eventuais estatutos que excluam esta exigência.
São aprovados os alunos com uma média final mínima de 10 valores.
Os alunos que não obtenham aproveitamento na avaliação contínua ou desistam da mesma poderão realizar exame de recurso.
Exame de Recurso:
O exame de recurso (época normal e época especial) tem uma ponderação de 100% e duração de 3 horas. Aplica-se o Regulamento Geral de Avaliação da ULP em vigor.
Os alunos com 8 ou 9 em exame de recurso poderão realizar prova oral, facultativa.
