Class Public International Law

It is sought that students acquire knowledge about the structure of Public International Law, its foundations and sources, as well as about the way of relationship and interaction of international subjects and the relationship with national legal orders, especially Portuguese. From a material perspective, conflict law and international protection of human rights will be addressed as central aspects of the DIP. It is intended that students are able to appreciate the international news with a critical spirit, seeing the features of normativity and inherent international justice.

1. Objectives of Public International Law. Public International Law (DIP) vs Domestic Law vs Private International Law. 2. The sources of DIP: the custom; the general principles of international law; jurisprudence (the International Court of Justice and the International Criminal Court) and doctrine; equity; International Conventions (phases and procedures for concluding the Treaties; Reserves; Modification of the Treaties and Termination). 3. The subjects of ID: States and their classification; The jurisdiction of States; Other Subjects of International Law: International Organizations and their role in the international community; The Holy See; the Red Cross; Belligerents and the Insurgents; the individual. 4. Teaching methodology: - Theoretical-practical classes - Thematic exhibitions, following a presentation scheme previously prepared. - Classes must be accompanied by reading the recommended bibliography. - Encouraging participation. Students will be instructed to read the recommended bibliography in advance and to actively participate in the discussions of the issues under analysis.
