This curricular unit aims to stimulate student interest in mastering the theoretical and practical tools needed to understand the old and new challenges of criminal evidence, especially in the light of the latest technological advances, thus promoting critical thinking. This implies developing the ability to analyse and evaluate both the set of legal norms that make up the Law of Evidence in criminal matters and its specialised doctrine, as well as, in particular, its rich jurisprudence on specific issues.

Objectives
Without prejudice to the appropriate systematic-conceptual framework of the topics covered, a problematic method based on case studies will be favoured. This, in turn, will encourage the development of the heuristic-explanatory and discursive-argumentative capacities required for a fair solution to the problems specifically dealt with, while respecting fundamental rights and guarantees.

Teaching methodologies
Teaching methodologies
The analysis of specific doctrinal controversies and concrete judicial decisions, with the organisation of the arguments presented by the different parties, will encourage a dynamic of greater student participation, with the assumption of an active role in the pedagogical and scientific process. A multidisciplinary methodology will also be promoted, concerned with empirical aspects of the phenomenon of judicial persuasion, both in general terms, as shown by the influence of new technologies on the production of evidence, and in particular, as illustrated by the subject of testimonial evidence.

Assessment
- Assiduidade: nos termos regulamentares, exige-se a presença mínima obrigatória de 75% das aulas.
- Pontualidade.
- A senhoras e senhores estudantes serão avaliados em regime de avaliação contínua, que terá como principal elemento a elaboração, a apresentação e a entrega de um trabalho (relatório ou artigo). Tal permitirá, no horizonte de acompanhamento permanente e progressivo característico dos working papers, a apreciação do caminho individualmene trilhado na unidade curricular, segundo parâmetros de evolução do estudo realizado e do desenvolvimento das aptidões de discurso oral e escrito.
- Também será valorada, no âmbito da avaliação contínua, a participação individidual em cada uma das aulas ministradas, sempre com a finalidade de aperfeiçoamento das capacidades crítico-argumentativas nas diferentes etapas.
- A participação (facultativa) das senhoras e senhores estudantes, na condição de ouvintes, em um evento (colóquio, seminário, conferência, etc.) promovido pela Faculdade de Direito da Universidade Lusófona, desde que acompanhada pela entrega de um pequeno relatório escrito, poderá ser valorada até ao limite de 5 % da classificação total.
