Debate on Equality and Workplace Discrimination with Global Experts

National and international experts analysed labour challenges and legal mechanisms to combat discrimination in the workplace

On 18 November 2024, the Salão Nobre of Lusófona University - Porto University Centre hosted an important conference dedicated to equality and non-discrimination in labour relations. The event brought together national and international experts, students, jurists, judicial operators, and representatives of entities such as the Commission for Equality in Labour and Employment (CITE) and the Labour Conditions Authority (ACT).

Moderated by Prof. Dr Joana Neto, the conference highlighted the importance of reflecting on regulatory and legal challenges to combat workplace discrimination. The opening session featured a welcome address by the moderator, who gave special attention to undergraduate students, emphasising the relevance of the topic for future labour practices.

The event began with a remote presentation by Guilherme Dray from the Faculty of Law at the University of Lisbon. The presentation focused on the fundamental concepts of equality and non-discrimination, emphasising the democratic values enshrined in international treaties and national constitutions.

Next, Maria Luísa Alves from ISCTE-IUL discussed the monitoring mechanisms of the Council of Europe and the contributions of the European Social Charter, with particular emphasis on the jurisprudence of the European Court of Human Rights and the European Court of Justice (ECJ).

Throughout the conference, various factors of workplace discrimination were analysed. Lisa Waddington from Maastricht University highlighted the need for reasonable accommodations for people with disabilities, presenting relevant jurisprudence from the European Court of Justice (ECJ). Bruno Mestre addressed racial and ethnic discrimination, providing historical examples and landmark decisions such as the ECJ CHEZ case (C-83/14), which dealt with indirect discrimination against Roma populations. Susana Sousa Machado explored issues related to religious discrimination, including the use of religious symbols at work and the adjustment of schedules for faith practices. Luísa Andias Gonçalves highlighted the challenges faced by women in the labour market, such as career progression barriers and persistent prejudices. Ana Sofia Carvalho analysed age discrimination, referring to the protection provided under Directive 2000/78/EC. Finally, António Monteiro Fernandes closed this segment with a reflection on discrimination based on political convictions, ideological beliefs, or trade union membership, emphasising the importance of safeguarding fundamental freedoms.

Emerging issues such as algorithmic discrimination were also discussed. Master Mariana Alves Teixeira explained how algorithmic errors can perpetuate inequalities, while Master Pedro Barrambana Santos addressed workplace bullying, exploring its causes and available legal mechanisms.

A roundtable discussion, moderated by Elisabete Ramos, concluded the event. Fernanda Campos, Inspector General of ACT, reflected on the institution's role in protecting against workplace discrimination. Carla Tavares, president of CITE, highlighted gender equality, while Master Filipe Lamelas analysed the importance of collective bargaining. Maria Regina Redinha wrapped up the debate by addressing risks and opportunities in the current context.
